These Terms and Conditions (“Agreement”) govern your use of the Ingot Auction online platform (“Platform”) for participating in live and online auctions. By accessing or using the Platform, you agree to comply with and be bound by these Terms and Conditions.
Please read them carefully. If you do not agree to these Terms and Conditions, you must not use the Platform.
1. Registration and Account
To participate in an auction or use the Platform, you must create an account with Ingot Auction. You agree to provide accurate, current, and complete information during the registration process and update it as necessary.
You are responsible for maintaining the confidentiality of your account credentials, including your username and password.
You are solely responsible for all activities that occur under your account.
2. Eligibility
You must be at least 18 years old to participate in the Platform’s auctions.
You agree that you have the legal capacity to enter into binding agreements and that you comply with all applicable laws and regulations in your jurisdiction.
3. Auction Process
Ingot Auction offers live and online auctions for various categories of items, including but not limited to fine art, antiques, collectibles, and luxury goods.
By placing a bid, you are making a binding offer to purchase the item. The highest bid at the close of the auction will be considered the winning bid.
Ingot Auction reserves the right to withdraw or cancel an auction, refuse any bid, or terminate any transaction at its discretion, without liability to you or any third party.
4. Bidding
All bids must be placed in the specified increments and follow the bidding rules for each auction.
Bids are final and cannot be retracted once placed. If you are the highest bidder at the end of the auction, you are legally obligated to purchase the item at the winning bid amount.
In the event of a technical issue, Ingot Auction reserves the right to extend or cancel the auction.
5. Buyer’s Premium and Fees
A buyer’s premium will be added to the winning bid amount. The buyer’s premium will be clearly disclosed on the auction listing.
All fees, taxes, shipping, and handling charges are the responsibility of the buyer unless otherwise specified.
Ingot Auction reserves the right to change fees or commissions at its discretion, with notice to users.
6. Payment
Payment for winning bids must be made within the time frame specified in the auction terms.
Payment can be made via the methods accepted on the Platform (e.g., credit card, bank transfer, etc.).
Failure to make payment within the required time may result in the cancellation of the sale and/or a penalty fee, and the item may be relisted.
7. Item Descriptions and Condition
Ingot Auction strives to provide accurate descriptions and photographs of all items listed for auction. However, all items are sold “as is” and without warranty, unless otherwise explicitly stated in the auction listing.
Bidders are encouraged to inspect items in person (if applicable) or contact Ingot Auction with questions prior to placing a bid.
Ingot Auction is not responsible for any discrepancies or errors in the descriptions or condition of the items listed.
8. Shipping and Delivery
The buyer is responsible for arranging and paying for the shipping of purchased items. Shipping and handling costs will be disclosed on the auction listing or at checkout.
Ingot Auction is not liable for any loss, damage, or delay during shipping, once the item has been shipped.
Delivery times are estimates and may vary.
9. Returns and Refunds
All sales are final. Returns or refunds are not permitted unless explicitly stated in the auction terms or required by law.
If an item is significantly not as described or damaged during shipment, you must contact Ingot Auction within 48 hours of receipt to resolve the issue.
10. Intellectual Property
All content on the Platform, including text, images, logos, and designs, is protected by copyright and other intellectual property laws. You may not use any content from the Platform without the express written consent of Ingot Auction.
11. Privacy and Data Protection
Ingot Auction values your privacy. By using the Platform, you consent to the collection, use, and sharing of your personal data as described in our Privacy Policy.
You agree to provide accurate and complete information and notify Ingot Auction of any changes to your personal data.
12. Limitation of Liability
Ingot Auction is not liable for any loss, damage, or expense arising from your use of the Platform or participation in any auction, including but not limited to lost profits, consequential damages, or technical issues.
Ingot Auction’s total liability to you for any claim related to the Platform is limited to the amount you paid for the specific auction item in question.
13. Prohibited Conduct
You agree not to engage in any conduct that may disrupt the functioning of the Platform, violate applicable laws, or interfere with other users’ participation in auctions.
Fraudulent, abusive, or manipulative bidding practices (including shill bidding or bid manipulation) are strictly prohibited.
14. Termination and Suspension
Ingot Auction reserves the right to suspend or terminate your account if you violate these Terms and Conditions or if your account is inactive for an extended period.
If your account is terminated, you will still be responsible for any outstanding payments or obligations.
15. Amendments
Ingot Auction reserves the right to amend or update these Terms and Conditions at any time. All changes will be posted on the Platform, and your continued use of the Platform constitutes acceptance of the updated Terms and Conditions.
